The Attorney General of the Federation (AGF) and Minister of Justice, Prince Lateef Fagbemi (SAN), has affirmed that the continued stay in office of the Inspector General of Police (IGP), Kayode Egbetokun, is legal and in line with the provisions of the amended Police Act.
In a statement released on Wednesday, the AGF clarified that Egbetokun’s tenure, which commenced on October 31, 2023, would have ended upon his attainment of 60 years of age on September 4, 2024. However, an amendment to the Police Act in 2024 now allows the IGP to serve a full four-year tenure, irrespective of the mandatory retirement age.
“Before his retirement age, the Police Act was amended to allow the occupant of the office to complete the original four-year term granted under Section 7(6) of the Act, notwithstanding the fact that he has attained the age of 60 years,” the AGF explained.
The amendment effectively extends Egbetokun’s tenure until October 31, 2027, ensuring he completes his four-year term as prescribed by law.
“For the avoidance of doubt, Egbetokun’s continued stay in office aligns with the provisions of the Police Act as amended in 2024, which grants a four-year tenure from the date of appointment,” the statement added.
The AGF’s clarification comes amid public discourse regarding the IGP’s tenure, reinforcing that his continued leadership of the Nigeria Police Force remains within legal bounds.
